इलाहाबाद उच्च न्यायालय ने यूपी असिस्टेंट प्रोफेसर पुनर्परीक्षा के मूल्यांकन को केवल पांच “दागदार” विषयों तक सीमित किया, 28 बेदाग विषयों के उम्मीदवारों को दी राहत

इलाहाबाद उच्च न्यायालय ने आज विशेष अपील संख्या 368 वर्ष 2026 में एक महत्वपूर्ण फैसला सुनाया है। अदालत ने उत्तर प्रदेश शिक्षा सेवा चयन आयोग (UP Education Service Selection Commission) के असिस्टेंट प्रोफेसर उम्मीदवारों के लिए सभी विषयों की पुनर्परीक्षा आयोजित करने के फैसले में महत्वपूर्ण बदलाव किया है।

न्यायमूर्ति सौमित्र दयाल सिंह और न्यायमूर्ति स्वरूपमा चतुर्वेदी की खंडपीठ ने फैसला सुनाया कि संपूर्ण लिखित परीक्षा को रद्द करना असंगत (disproportionate) था, क्योंकि पेपर लीक के सबूत स्पष्ट रूप से 33 में से केवल पांच विषयों तक ही सीमित थे।

मामले की पृष्ठभूमिमूल परीक्षाः 33 विषयों में असिस्टेंट प्रोफेसर के 910 पदों पर चयन के लिए मूल रूप से 16 और 17 अप्रैल, 2025 को लिखित परीक्षा आयोजित की गई थी।

पेपर लीक के आरोप: पेपर लीक की जांच के बाद आयोग और राज्य सरकार ने सभी विषयों के लिए नई परीक्षा का आदेश दिया था। जांच में आयोग के एक संविदा कर्मचारी महबूब अली और शॉर्टलिस्ट किए गए 18 उम्मीदवारों की संलिप्तता का खुलासा हुआ था। लीक का दायराः न्यायालय ने पाया कि लीक के स्थापित साक्ष्यों से केवल पांच विशिष्ट विषयों के उम्मीदवारों को लाभ हुआ: उर्दू, हिंदी, भूगोल, समाजशास्त्र और जंतु विज्ञान।

व्यापक साक्ष्यों का अभावः न्यायालय ने उल्लेख किया कि, प्राथमिकी (FIR) दर्ज होने के एक वर्ष बीत जाने के बावजूद, ऐसा कोई सबूत सामने नहीं आया है जो यह बताए कि पेपर लीक ने शेष 28 विषयों को प्रभावित किया है, जिनमें 682 पद शामिल हैं।

न्यायालय का निर्णय और निर्देशसर्वोच्च न्यायालय द्वारा स्थापित “आनुपातिक कार्रवाई” परीक्षण को लागू करते हुए, उच्च न्यायालय ने निर्धारित किया कि दागदार और बेदाग उम्मीदवारों को अलग किया जा सकता है। यद्यपि न्यायालय ने अंतिम समय में होने वाली असुविधा से बचने के लिए 18 अप्रैल, 2026 को निर्धारित पुनर्परीक्षा को जारी रखने की अनुमति दी, लेकिन इसने बेदाग उम्मीदवारों की सुरक्षा के लिए सख्त निर्देश जारी किए:

28 बेदाग विषयों (जैसे अंग्रेजी, रसायन विज्ञान, कानून, इतिहास, भौतिकी आदि) के उम्मीदवारों के लिए 18 अप्रैल, 2026 की पुनर्परीक्षा की ओएमआर (OMR) शीट का मूल्यांकन न करे।

मूल्यांकन 5 दागदार विषयों तक सीमितः आयोग 18 अप्रैल, 2026 की पुनर्परीक्षा से

केवल उन उम्मीदवारों की ओएमआर शीट का मूल्यांकन करेगा जो पांच दागदार विषयों: उर्दू, समाजशास्त्र, जंतु विज्ञान, हिंदी और भूगोल में उपस्थित होंगे।

संशोधित साक्षात्कार शॉर्टलिस्ट: अंतिम साक्षात्कार चरण के लिए, आयोग को 28 बेदाग

विषयों के लिए अप्रैल 2025 की मूल परीक्षा से शॉर्टलिस्ट किए गए उम्मीदवारों को संकलित करना होगा, और उन्हें पांच दागदार विषयों के लिए पुनर्परीक्षा से नए शॉर्टलिस्ट किए गए उम्मीदवारों के साथ मिलाना होगा।

विशेष अपील को आंशिक रूप से स्वीकार कर लिया गया, जिससे यह सुनिश्चित हुआ कि कदाचार से अप्रभावित विषयों के उम्मीदवारों को अनुचित रूप से दंडित न किया जाए। विशेष अपील में उम्मीदवारों का प्रतिनिधित्व वरिष्ठ अधिवक्ता श्री राहुल श्रीपत और अधिवक्ता श्री इशिर श्रीपत ने किया।

Evaluation to Five “Tainted” Subjects, Protects Candidates in 28 Untainted Disciplines

April 17, 2026 – The High Court of Judicature at Allahabad has issued a crucial ruling today in Special Appeal No. 368 of 2026, significantly altering the Uttar Pradesh Education Service Selection Commission’s decision to conduct a blanket re-examination for Assistant Professor candidates.

The Division Bench, comprising Hon’ble Saumitra Dayal Singh, J., and Hon’ble Swarupama Chaturvedi, J., ruled that the cancellation of the entire written examination was disproportionate, as evidence of a paper leak was strictly confined to only five out of the 33 examined disciplines.

Background of the Case

The Original Examination: The written examination was originally conducted on April 16 and 17, 2025, for the selection of 910 Assistant Professors across 33 disciplines.

The Paper Leak Allegations: The Commission and State Government had ordered a fresh examination for all subjects following investigations into a paper leak. The investigation revealed the involvement of a contractual employee of the Commission, Mehboob Ali, and 18 shortlisted candidates.

The Scope of the Leak: The Court observed that the established evidence of the leak solely benefited candidates in five specific disciplines: Urdu, Hindi, Geography, Sociology, and Zoology.

Lack of Broad Evidence: The Court noted that, despite a year passing since the FIRs were filed, no evidence has emerged to suggest that the paper leak affected the remaining 28 disciplines, which encompass 682 posts.

The Court’s Ruling and Directives

Applying the “proportionate action” test established by the Supreme Court, the High Court determined that the tainted and untainted candidates could be segregated. While the Court allowed the scheduled re-examination on April 18, 2026, to proceed to avoid last-minute disruption, it issued strict directives to protect untainted candidates:

No Evaluation for 28 Untainted Subjects:

The Commission is directed not to evaluate the OMR sheets from the April 18, 2026 re-examination for candidates in the 28 untainted disciplines (such as English, Chemistry, Law, History, Physics, etc.).

Evaluation Limited to 5 Tainted Subjects: The Commission will only evaluate the OMR sheets from the April 18, 2026 re-examination for candidates appearing in the five tainted disciplines: Urdu, Sociology, Zoology, Hindi, and Geography.

Revised Interview Shortlist:

For the final interview stage, the Commission must collate the shortlisted candidates from the original April 2025 examination for the 28 untainted disciplines, and combine them with the newly shortlisted candidates from the re-examination for the five tainted disciplines.

The special appeal was partly allowed, ensuring that candidates in subjects unaffected by the malpractice are not unfairly penalized.
