अंबेडकर नगर निवासी राजेश यादव की गिरफ्तारी पर रोक

राजेश यादव निवासी अंबेडकर नगर को देवरिया जिले के लार थाने की पुलिस ने काऊ सलाटर एक्ट (गोबध निवारण अधिनियम) में फर्जी फंसा कर जेल भेज दिया था। जबकि राजेश यादव की उम्र केवल 18 साल की थी। हाईस्कूल पास करके वह ग्यारह वीं कक्षा में प्रवेश लेना चाह रहा था। वह मौके पर पकड़ा भी नहीं गया था। लार थाने की पुलिस उसे घर से पकड़ा और पेट्रोल पंप पर दिखा दिया।

उसकी जमानत सेशन जज देवरिया ने खारिज कर दिया था। श्री बी डी निषाद अधिवक्ता उच्च न्यायालय इलाहाबाद प्रयागराज ने हाईकोर्ट में उक्त तथ्यों का खुलासा करते हुए जमानत प्रार्थना पत्र डाला। माननीय हाईकोर्ट ने अधिवक्ता बीडी निषाद की दलील मान ली और राजेश यादव को जमानत पर छोड़ दिया।

सिर्फ एक केस काऊ सलाटर एक्ट (गोबध निवारण अधिनियम) का हवाला देकर लार थाने के एस आई वाजपेयी ने एसपी और डीएम से संस्तुति लेकर फिर उसी लार थाने में गैंगस्टर एक्ट में एफआईआर दर्ज करके उत्पीड़न की कार्यवाही की और गिरफ्तारी के लिए छापेमारी शुरू कर दी।

अधिवक्ता बीडी निषाद ने इस एफआईआर को माननीय हाईकोर्ट में चैलेंज किया। माननीय हाईकोर्ट ने अधिवक्ता के तर्कों को कानून के दुरुपयोग और सालिट्री केस मानते हुए राजेश यादव की गिरफ्तारी पर रोक लगा दिया और सरकार से जबाब तलब कर लिया।  जुलाई में अगली सुनवाई होगी।

1. Heard learned counsel for the petitioner, learned AGA for the State and perused the record.

2. Learned counsel for the petitioner has submitted that only on the basis of a solitary case, the impugned first information report under the Gangster Act has been slapped against the petitioner and as such, the impugned first information report is liable to be quashed.

3. Matter requires consideration.

4. Learned AGA prays for and is granted three weeks’ time to file counter affidavit.

5. Rejoinder affidavit, if any, may be filed within one week thereafter.

6. List on 2.7.2025 before the appropriate Bench.

7. Till then, the petitioner shall not be arrested in pursuance of FIR dated 16.11.2024 arising out of Case Crime No. 0421 of 2024, under Section 3(1) of U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, Police Station- Lar, District-Deoria.
