Allahabad High Court has given direction to Managing Director, UP State Agro Industrial Corporation Limited Lucknow to appear in person and explain the cause for failure of the respondents to give any time frame during which the amounts shall be paid.
Counsel for Petitioner, Mr Dinesh Kumar Misra Petitioner Hari Om of DISTRICT-SHAHJAHANPUR was appointed on the post of Assistant (Group -D) in the respondent corporation (Herein after referred as Corporation) and was working in the office of the Corporation at District Gorakhpur under the control/supervision of respondent no.6. After attaining age of the superannuation he retired from the service on 30.12.2023. In this regard an office order dated30.12.2023 was issued by the respondent no.6.
Petitioner has discharged his duties with utmost efficiency and without complaint from any corner in his entire service period.
After retirement petitioner was not paid his entire retiral dues i.e. Gratuity, E.P.F and Leave Encashment as well as regular salary from the month of June, 2022 to December, 2023 (18 Months). Petitioner submitted a representation dated 05.07.2024 before the respondent no.3 wherein he requested for payment of his entire retiral dues as well as unpaid salary of 18 months but authority concerned did not paid any heed.
“Shri Akhilesh Kumar Singh, learned counsel holding brief of Shri Ved Byas Mishra, learned counsel for the petitioner submits that the retiral dues and other terminal benefits of the petitioner have not been disbursed to him due to paucity of funds.
He could not give any time frame in which the aforesaid amounts will be released. The stand of the respondent Corporation has caused great concern to the Court.
