Prayagraj Branch of the Institute of Chartered Accountants of India organized a Study Circle Meeting on  “Challenges & Opportunities for CA Profession in Faceless Assessment and Appeal under the Income Tax Act , 1961 “ at Branch Office in Tulsiani Plaza , Prayagraj wherein Past Chairman CA (Dr.) Navin C. Agrawal was Keynote Speaker presided by Branch Chairman CA Rajesh Kumar Pandey wherein CA’s in large number participated .

Keynote Speaker CA Navin C. Agrawal outlined the background of the Scheme and added that it is to impart greater transparency and accountability by eliminating the interface between Assessing Officer and the assessee ( or his representatives ) .

Further , with the use of technology in the form of Artificial Intelligence assessments can conveniently be made . Government is firm on its implementation , same litigations about the Scheme were there which are settled in view of consequential amendment . Talking about the challenges in comparision to earlier physical hearing , he opined that now assessee must be sound on facts , that is , there must be perfect vouchers , proper narration and heads of accounts in the books of account with complete details of suppliers and buyers . Besides , attention must be paid on compliances of the provisions of the Act . On the basis of details , NFAC may issue Notices under Section 133 ( 6 ) to confirm the details furnished . So far as , opportunities are concerned , he said that now one can attend the proceedings on national level . Prospects of re – opening of case are likely to increase . Befitting replies are the need of hour .

He outlined the Faceless Assessment Scheme 2019 which has been incorporated entirely in Section 144B of the Act w.e.f.01.04.2021 . Accordingly , NFAC shall facilitate the conduct of these proceedings in centralized manner through Assessment Unit ( AU ) , Verification Unit ( VU ) , Technical Unit ( TU ) and Review Unit ( RU ) . All communications shall be on registered account of assessee with a copy on registered email . In any case , sufficient checks and balances have been laid down so that injustice is not caused to the assessee , at the sametime proper revenue is collected by the exchequer . Faceless Appeal Scheme , 2021 was also briefed .

(डॉ.) नवीन सी. अग्रवाल मुख्य वक्ता थे, जिसकी अध्यक्षता शाखा अध्यक्ष सीए राजेश कुमार पाण्डेय ने की, जिसमें बड़ी संख्या में सीए ने भाग लिया। मुख्य वक्ता सीए नवीन सी. अग्रवाल ने योजना की पृष्ठभूमि को रेखांकित किया और कहा कि यह निर्धारण अधिकारी और निर्धारिती (या उसके प्रतिनिधियों) के बीच इंटरफेस को समाप्त करके अधिक पारदर्शिता और जवाबदेही प्रदान करना है। इसके अलावा, आर्टिफिशियल इंटेलिजेंस के रूप में प्रौद्योगिकी के उपयोग से आसानी से आकलन किया जा सकता है। सरकार इसके कार्यान्वयन पर दृढ़ है, योजना के बारे में जो मुकदमे थे, उनके संबंध में परिणामी संशोधन के मद्देनजर समाप्त हो गए हैं।

पहले आमने सामने की सुनवाई की तुलना में चुनौतियों के बारे में बात करते हुए, उन्होंने कहा कि अब निर्धारिती को तथ्यों पर मजबूत होना चाहिए, यानी, आपूर्तिकर्ताओं और खरीदारों के पूर्ण विवरण के साथ खाते की किताबों में सही वाउचर, उचित विवरण और खातों के शीर्ष होने चाहिए। इसके अलावा, अधिनियम के प्रावधानों के अनुपालन पर ध्यान दिया जाना चाहिए। विवरण के आधार पर, NFAC प्रस्तुत विवरण की पुष्टि करने के लिए धारा 133 (6) के तहत नोटिस जारी कर सकता है। जहां तक ​​अवसरों का संबंध है, उन्होंने कहा कि अब कोई भी राष्ट्रीय स्तर पर कार्यवाही में भाग ले सकता है। मामले के फिर से खुलने की संभावना बढऩे की संभावना है। उपयुक्त उत्तर समय की मांग है।

उन्होंने फेसलेस असेसमेंट स्कीम 2019 को रेखांकित किया, जिसे 01.04.2021 से अधिनियम की धारा 144बी में पूरी तरह से शामिल किया गया है। तदनुसार, एनएफएसी मूल्यांकन इकाई (एयू), सत्यापन इकाई (वीयू), तकनीकी इकाई (टीयू) और समीक्षा इकाई (आरयू) के माध्यम से केंद्रीकृत तरीके से इन कार्यवाहियों के संचालन की सुविधा प्रदान करेगी। सभी संचार पंजीकृत ईमेल पर एक प्रति के साथ निर्धारिती के पंजीकृत खाते पर होंगे। किसी भी मामले में, पर्याप्त जांच और संतुलन रखा गया है ताकि निर्धारिती के साथ अन्याय न हो, साथ ही राजकोष द्वारा उचित राजस्व एकत्र किया जा सके। फेसलेस अपील योजना, 2021 की भी जानकारी दी गई।
